Hukuk Dairesi, yerel mahkeme karar\u0131n\u0131 hukuka uygun buldu.<\/p>\n<p>\n\tBo\u015fanmas\u0131na karar verilen erkek, yerel mahkeme h\u00fckm\u00fcne itiraz ederek dosyay\u0131 Yarg\u0131tay&#8217;a ta\u015f\u0131d\u0131.<\/p>\n<p>\n\tTemyiz incelemesini yapan Yarg\u0131tay 2. Hukuk Dairesi, yarg\u0131lama a\u015famas\u0131ndaki usuli i\u015flemler ile taraflar\u0131n bo\u015fanmas\u0131na ili\u015fkin h\u00fck\u00fcm y\u00f6n\u00fcnden yerel mahkeme karar\u0131n\u0131n onanmas\u0131na, kad\u0131na yoksulluk nafakas\u0131 ba\u011flanmas\u0131 y\u00f6n\u00fcnden ise h\u00fckm\u00fcn bozulmas\u0131na karar verdi.<\/p>\n<p>\n\tDairenin karar\u0131nda, kad\u0131n\u0131n emekli oldu\u011fu, d\u00fczenli ve sabit bir gelirinin bulundu\u011fu, ayr\u0131ca taraflar\u0131n gelir durumlar\u0131n\u0131n da birbirlerine yak\u0131n veya denk oldu\u011fu ifade edildi.<\/p>\n<p>\n\tTaraflar\u0131n gelir durumlar\u0131na ili\u015fkin tespit kar\u015f\u0131s\u0131nda kad\u0131na nafaka verilmesinin hukuka ayk\u0131r\u0131 oldu\u011fu belirtilen kararda, &#8220;Bu durum kar\u015f\u0131s\u0131nda, davac\u0131 kad\u0131n yarar\u0131na 4721 say\u0131l\u0131 T\u00fcrk Medeni Kanunu&#8217;nun 175. maddesinde d\u00fczenlenen yoksulluk nafakas\u0131 ko\u015fullar\u0131 olu\u015fmam\u0131\u015ft\u0131r.
